as ‘the Lessee’) residing at _______________________________________ for the Free Lease of one mule as described and identified below:

Owner agrees to lease the mule described and identified herein to the Lessee for ZERO Dollars
($0.00) per month.
Owner warrants that he/she is the lawful owner of said mule and has the right to Free Lease said mule.
Leasee is responsible for returning the mule within two weeks (2 weeks) notice by owner if requested by owner at their cost or within 2 weeks of notifying owner they (lease) wish to return the mule. Mule must be returned in satisfactory condition equal to or better to how it left the owner when returned.
Lessee warrants that he/she will provide the said mule with care above and beyond that which the state of North Carolina deems minimal humane treatment of an Equine. This care includes paying for board/care and providing food, water, and shelter for said mule; in winter in a clean, safe barn or a run in shelter during all seasons; access to a safe pasture with fencing sufficient to keep the mule safe and in the pasture for grazing, and exercise; regular maintenance of the said mule’s hooves via regular barefoot trims or farriery, and regular grooming, administrations of deworming medications, health care including annual inoculations and teeth floating (if needed), exercise, nutrition and displays of kindness necessary to maintain the said mule in his/her current state of physical and emotional health which Owner warrants, and said
mule’s Veterinarian will concur, is excellent.
Lessee warrants that she/he does not have the right to sell, lend, sub-lease, move, or otherwise dispose of the said mule.
Lessee warrants that she/he has substantial experience working with and handling mules as a rider, trainer, and groom. Lessee warrants that she is aware of the substantial risk of personal injury that can be sustained while riding or working around equine and agrees to hold Owner harmless of all liability of any
Injury to persons or property caused by the mule while the said mule is in the Lessee’s care. Lessee warrants that she will use ‘best judgment’ in emergency situations and will inform Owner as soon as possible if such situations arise. Owner reserves the right to make all decisions regarding the health and welfare of the mule, including decisions about life saving or on-going treatments at leasee’s cost. The leasee has the right to fully insure said animal if wanted but if they chose not to insure animal they will be responsible for death or injury that prevents mule from being used as he was prior to lease at a value of $_______________ (_________________________ dollars US) as well as full payment on any vet or farrier bills to return mule to condition it was in prior to lease. Leasee is agreeing at time of pickup of leased mule whether it be via lease transport or hauler/hired transporter that mule is on great health and soundness. Leasee accepts immediate responsibility for mule once it leaves owners property for pickup and until mule is delivered back to owner, including all forms of transport.
The term of this Lease Agreement is renewable automatically every month, however, Lessee may terminate this agreement with a minimum of two weeks notice to the Owner at any time. Owner reserves the right to request return of the mule at leasers expense with a minimum of two weeks notice to Lessee. Leasee is aware that mule will remain for sale and can be sold at any time during the lease by request of the owner. Leasee agrees to show said mule to prospective buyers at no expense to owner in exchange for free use of said animal, Leasee will have first right to purchase mule at same price offered to prospective buyers if a serious offer is made on the mule. The lease will have 48 buisness hours to decide and send payment via wire transfer before mule can be sold to an outside party.
Breach and Cure
1. Owner reserves the right to terminate this agreement immediately if the mule is not
maintained by the Lessee according to the terms of this agreement.
2. Cure: Lessee has 15 days to remedy the breach according to the terms of this agreement.
One cause for breach would be if said mule jumps a fence that takes him/her
out of the pasture onto a road. The cause for breach is not limited to this instance. Any
form of negligence is cause for breech.
All notices may be sent to the Owner at the address listed herein or email _________________. All notices may be sent to the Lessee at the address herein or email_________________. US Mail with return receipt requested or an alternative delivery system such as Federal Express constitute the mode of delivery of notices.
This agreement constitutes the entire agreement between the Owner and the Lessee. The invalidity or enforceability of any provision of this agreement shall not affect the validity or enforceability of any other provision of this agreement, which shall otherwise remain in full force and effect. This agreement may be executed in one or more counterparts, each of which shall be deemed to be an original but all of which together shall constitute one and the same instrument.
The Laws of the State of North Carolina shall govern this agreement. Any litigation
will take place in Iredell County, NC 28677.
